Inheritance Rights of the Child Caring for Their Parents
⚖️ Legal Inheritance Shares Do Not Change Inheritance shares do not vary based on a child’s caregiving duties. A child who provides more care for their parents is not legally entitled to a larger share of the inheritance. The inheritance is distributed according to legal shares and the principle of equality.
🏡 Assets That Can Be Transferred While Alive The person leaving the inheritance may donate or transfer part or all of their assets to the child who provides more care or attention.
⚠️ Can Be Challenged Through a Reduction Lawsuit Other heirs can file a reduction lawsuit (tenkis davası) after the person's passing to annul such transfers. Heirs with reserved shares can file a lawsuit within one year (or up to ten years at the latest) after the death of the deceased.
🔍 Court Review and Reserved Shares The court examines transactions that violate reserved shares and may order their annulment if necessary.
📜 Exception: Lifetime Care Agreement If the deceased signed a lifetime care agreement before a notary with the child who provided regular care, other heirs cannot challenge this transaction.
🛡️ Legal Protection of This Agreement Since a lifetime care agreement includes mutual obligations and debts, it prevents other heirs from filing a reduction lawsuit.
